The Workers’ Compensation system in Louisiana provides both financial and medical benefits to employees who were injured on-the-job and is intended to help employees and their families manage the many challenges associated with an on-the-job accident, injury, or occupational disease. In order to be eligible to receive Workers’ Compensation benefits, an employee must have been injured within the course and scope of his or her employment. Injured employees who are eligible for Workers’ Compensation benefits are entitled to monetary restitution in a fixed amount. This amount is two-thirds of the employee’s normal salary for the time in which they cannot work due to injury. In addition to financial benefits, eligible employees also have the right to medical care under the Workers’ Compensation Act.
One important and critical restriction under Louisiana Law is that the injured employee only has one opportunity to choose a treating doctor. If the employee accepts the doctor chosen by the employer, then you can usually expect a poor result since the doctor chosen by the employer is more concerned with protecting the employer’s interests.
